Please read this Terms of Service Agreement ("Agreement") carefully before using Phone (the "App"), developed by Mobile Creator Works ("we," "our," "us," or the "Developer"). This Agreement grants us certain rights and explains how you can manage the information shown to others through the App's caller identification and location display features. Please also review our Privacy Policy for additional detail on how your information is handled.

Article I — Eligibility

To use the App, you must be at least thirteen (13) years old (the "Minimum Age"). If you are between thirteen (13) and eighteen (18), you must have consent from a parent or legal guardian.

Where applicable law requires a higher minimum age for Mobile Creator Works to provide the Services — including the collection, storage, and use of your contact information — that higher age will apply instead. The App is not intended for use by anyone under 13 years of age.

Our Privacy Policy describes in greater detail what information you may share through the App, and how Mobile Creator Works may use and share it.

Article II — Contact Data and Enhanced Search

By using the App, you agree that it operates in accordance with the Mobile Creator Works Privacy Policy.

If you opt in to the App's Enhanced Search functionality, you agree that we may collect, use, and share certain information from your device's phone book ("Contact Information") with other users of the App, in accordance with our Privacy Policy, in order to provide more accurate caller identification and search results.

By enabling this feature, you grant Mobile Creator Works the right to use your Contact Information as part of the Service, and you confirm that you hold any permissions required to share such information with us. You may disable this feature and opt out of further sharing at any time from the App's Settings.

Article III — Caller Identification and Location Features

The App may display a caller's name, associated business or listing information, or an approximate general location, based on publicly available data, information contributed by other users, and Contact Information shared through the App. These features are provided as a convenience only. Mobile Creator Works does not guarantee the accuracy, completeness, or timeliness of any caller identification or location information displayed.

Article IV — Third-Party Disclosure

We do not sell, trade, or otherwise transfer your Personally Identifiable Information to outside parties, except with advance notice to you. Mobile Creator Works retains "Compiled Data" and "Non-Identifiable Data" and does not share your "Personal Data" with third parties beyond what is described in this Agreement or our Privacy Policy.

To improve the quality of the caller identification service, you agree that we may share your Personal Data with external technical developers who have entered into a non-disclosure agreement with Mobile Creator Works.

This does not include hosting and operational partners who assist us in running the App, provided such parties agree to keep the information confidential. We may also disclose information where required by law, to enforce our policies, or to protect the rights, safety, or property of Mobile Creator Works, our users, or others.

Article V — Acceptable Use

While using the App, you agree that you will not:

(a) share Contact Information that you do not have permission to share; (b) use the App to harass, threaten, stalk, or impersonate any person; (c) attempt to access, alter, or misuse another user's data; (d) use the App in violation of any applicable telecommunications, privacy, or data protection law.

Article VI — Intellectual Property

The App's design, source code, caller identification database, trademarks, and branding are the exclusive property of Mobile Creator Works or its licensors. You are granted a limited, personal, non-transferable, revocable license to use the App for its intended purpose. You may not copy, reverse-engineer, resell, or redistribute the App or its underlying data.

Article VII — Disclaimer of Warranties

The App, including its caller ID and location features, is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by applicable law. Mobile Creator Works does not warrant that results displayed through the App will be accurate, complete, or current.

Article VIII — Limitation of Liability

To the maximum extent permitted by law, Mobile Creator Works shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including damages resulting from inaccurate caller identification or location information. This limitation does not apply to liability that cannot be lawfully excluded, such as for death, personal injury, or fraud.

Article IX — Changes to This Agreement

We may revise this Agreement periodically to reflect new features, business practices, or legal requirements. Continued use of the App after such changes take effect constitutes your acceptance of the revised Agreement.

Article X — Governing Law

This Agreement is governed by the laws applicable to Mobile Creator Works' principal place of business, without regard to conflict-of-law principles.
